1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Powerhouse General Contracting ("Powerhouse," "we," "us," or "our") regarding your use of our website at www.phgeneralcontracting.com (the "Site") and the construction services we provide (collectively, the "Services").

By accessing or using our Site or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or Services.

2. Intellectual Property Rights

The Site and its entire content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Powerhouse General Contracting, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the Site for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
  • If we provide social media features with certain content, you may take such actions as are enabled by such features.

3. User Representations

By using the Site or Services, you represent and warrant that:

  • All information you provide to us is true, accurate, current, and complete.
  • You will maintain the accuracy of such information and promptly update it as necessary.
  • You have the legal capacity to understand, agree to, and comply with these Terms.
  • You will not access the Site through automated or non-human means, except as specifically permitted by us in writing.
  • You will not use the Site for any illegal or unauthorized purpose.
  • Your use of the Site will not violate any applicable law or regulation.

4. Services

Powerhouse General Contracting provides a variety of construction and renovation services as described on our Site. The specific services to be provided to you will be detailed in a written agreement, proposal, or contract that is separate from these Terms (the "Service Agreement").

In the event of any conflict between these Terms and the Service Agreement, the terms of the Service Agreement shall prevail with respect to the specific services being provided.

4.1 Service Scheduling

After signing a Service Agreement, we will schedule your project based on our current workload and the complexity of your project. While we make every effort to begin and complete projects according to the estimated timeline, dates are not guaranteed and may be affected by factors such as weather conditions, material availability, permit approvals, or other circumstances beyond our control.

4.2 Site Access and Preparation

You agree to provide us with reasonable access to the property where services will be performed. You are responsible for ensuring the work area is reasonably prepared according to any pre-work instructions we provide. Additional charges may apply if additional preparation work is required.

5. Payments and Billing

The cost of our Services will be as stated in your Service Agreement. Unless otherwise specified in the Service Agreement:

  • A deposit (typically 30-50% of the total project cost) is required before work begins.
  • Progress payments may be required at specific milestones during larger projects.
  • Final payment is due upon completion of the services.
  • Payments can be made by check, credit card, or bank transfer as specified in your invoice.
  • Late payments will incur interest at the rate of 1.5% per month or the maximum rate allowed by law, whichever is lower.

Additional charges may apply for changes to the scope of work after the Service Agreement has been signed. Such changes must be documented in writing and approved by both parties.

6. Cancellation Policy

Our cancellation policy is as follows:

  • If you cancel a scheduled service more than 7 business days before the scheduled start date, your deposit will be refunded less a 10% administrative fee.
  • If you cancel within 7 business days of the scheduled start date, we reserve the right to retain up to 25% of your deposit to cover costs already incurred.
  • If you cancel after work has begun, you will be responsible for payment for all work completed up to the date of cancellation and any materials ordered specifically for your project.

We reserve the right to cancel or reschedule services due to circumstances beyond our control, such as severe weather conditions, material shortages, or workforce limitations. In such cases, we will make every effort to provide you with reasonable notice and reschedule at the earliest possible date.

7. Warranty and Guarantees

Powerhouse General Contracting provides a warranty on workmanship as specified in your Service Agreement. Typically, our standard warranty is as follows:

  • 1-year warranty on workmanship for all services we perform.
  • Manufacturer warranties apply to materials and equipment installed, which vary by product.

Our warranty covers defects in workmanship but does not cover:

  • Damage caused by normal wear and tear.
  • Damage caused by improper use or maintenance.
  • Alterations made by anyone other than Powerhouse General Contracting.
  • Acts of nature (floods, fires, earthquakes, etc.).

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POWERHOUSE GENERAL CONTRACTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR SERVICES;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE;
  • ANY CONTENT OBTAINED FROM THE SITE; AND
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICES AT ISSUE, OR $5,000, WHICHEVER IS GREATER.

THE LIMITATIONS OF LIABILITY SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN POWERHOUSE GENERAL CONTRACTING AND YOU.

9. Indemnification

You agree to defend, indemnify, and hold harmless Powerhouse General Contracting, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site or Services.

10. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site or Services shall be instituted exclusively in the federal courts of the United States or the courts of the Commonwealth of Pennsylvania, in each case located in Lehigh County, Pennsylvania. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Site thereafter.

Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.
